In so doing, Sasanian kings tried to establish their sovereignty as the highest point of imputation, especially by organizing Zarathustrian religion. The emergence of this element of sovereignty has persuaded some scholars that this kingship is an example of absolute sovereignty, whose most important legal consequence is the supremacy of political power over Law. This research tries to answer again the question of the relation between Sovereignty and law through analysis of different aspects of the concept of “sovereignty” and illuminate how dualistic political theology of this religion, in which God`s power cannot go beyond the “impossible” and “evilness”, restricted kings. Furthermore, some theological concepts such as “Khvarenah”, “Asha”, “Ideal kingship” and “Dad” established a kind of natural law which is slowly tied to a set of jurisprudential and legal norms. Therefore, this caught up with Sasanian kings. As a result, the establishment of concept of sovereignty as an inclusive authority became impossible. Furthermore, this research will explain how contradiction between subordination of kings to law and their claim of sovereignty as the highest point of imputation, which demands their infallibility, leads to the distinction of their natural personality from the legal personality of kingship which is embodied in Crown.}, keywords = {Sassanian,Sovereignty,Khvarenah,Asha,Ideal Kingship,Absolute Kingship,Restriction of Power}, title_fa = {بررسی جدال میان حاکمیت مطلقه و فقه در دوره‌ی ساسانی در پرتو الهیات سیاسی زردشتی}, abstract_fa = {استقلال امر سیاسی در دوره‌ی ساسانی نظام سیاسی را واداشت تا رابطه‌ی خود را با دیگر سپهرهای اجتماعی از نو تعریف کرده و بکوشد بر آنان چیره شود. بدین‌منظور شاهان ساسانی دست به تمرکز قدرت زده و حاکمیت در معنای نقطه‌ی برین انتساب را، به ویژه از طریق سازمان‌دادن به روحانیت زردشتی، محقق کردند. این امر سبب شده تا بسیاری از پژوهشگران این پادشاهی را، حداقل از منظر ایدئولوژی سیاسی آن، نمونه‌ای از شاهی مطلقه به شمار آورند که مهم‌ترین پیامد حقوقی آن ادعای فراتر بودن شاه از قواعد حقوقی موجود است. این پژوهش می‌کوشد تا در ضمن تحلیل دلالت‌های مختلف مفهوم «حاکمیت»، بار دیگر به پرسش از رابطه‌ی آن با حقوق در این دوره بپردازد و نشان دهد که چگونه الهیاتِ سیاسیِ دوبنی زردشتی که در آن قدرت خداوند مقید به «امکان» و «خیر» است و مفاهیم بنیادین آن همچون «فرّه»، «اشه»، «شاهی آرمانی» و «دادگری»، گونه‌ای از حقوق طبیعی‌ را ایجاد کردند که با مجموعه‌ای از قواعد فقهی-حقوقی همراه شد و از سطح هنجارهای اخلاقی صرف فراتر رفت. این‌گونه بود که شاهان ساسانی با سازمانمند کردن دین زردشتی در توری گرفتار شدند که خود تنیده بودند و امکان ایجاد حاکمیت مطلقه در معنای قدرت قانونگذاری را از دست دادند. در ادامه این پژوهش نشان می‌دهد که چگونه از دل جدال میان این قواعد فقهی-حقوقی با کوشش شاهان ساسانی برای تحقق حاکمیت مطلقه که نیازمند ادعای عصمت سیاسی است، منصب شاهی از شخص شاه متمایز و خطاناپذیری نه به شاه، بلکه به تاج نسبت داده شد.}, keywords_fa = {فرهنگ سیاسی,اشه,پادشاهی آرمانی,حاکمیت مطلقه,ساسانیان,فرّه,محدودیت قدرت}, url = {https://www.aclr.ir/article_249233.html}, eprint = {https://www.aclr.ir/article_249233_2a987432ce52483bce1a75a942a7cf53.pdf} }
